    Hi coaches,
    Just got an email from the rights owner. The details are as follows:

    Soldiers Field Digital LLC is the owner of the DoodleDazzles brand. We own the trademark for Dazzle in addition to a pending trademark for DoodleDazzles specifically. You were infringing on our brand name in your product title, probably for SEO benefits on Amazon. This is really harmful to our brand because it confuses customers about what is and isn’t our product. Anyone who puts “DoodleDazzles” or some variation in their product title on Amazon will get taken down.

    I have looked up their trademark Dazzle is for Arts and crafts set comprised of gel pens used for crafts, scrapbooking, coloring, journals, and other artistic outputs but mine is not the gel pens.

    I am thinking to reply by emphasizing I don’t intend to infringe her trademark. Will it be a good idea?

    I have around 80 units on hand.
    There will be 2000 units arriving next week and another 2000 units in the following week at my house.

    The sales are unexpectedly well. Amazon has a hard time keeping them in stock so I am using both FBA and FBM on this listing.

    I can relabel them nice and fast. LOL

    The package still has the “Dazzle” under the barcode. Do I need to ship back the inventory from amazon or I can change it with new inventory?

    I  don’t have too many units left at the amazon warehouse. I think it should be no problem to relabel.

    No. No one advises me to set up a new listing.
    I just made the new listing inactive. Do you think I can ask Amazon if I can set up a new listing without the trademarked terms?

    I guess now we just can use PPC and vine to launch. It is going to take longer to go to Page 1.

    Hi Coaches,
    No telling how long we are going to wait or the rights owner would be willing to send the retraction letter to Amazon. I  went ahead and create a new listing.
    Can I still use the last launch for this new listing? Does Last Launch against the Amazon TOS now?

    Here is the letter I composed:

    I am writing to you in response to the letter you sent to Amazon about trademark infringement on our product’s detailed page containing your trademarked term, Dazzle.

    With ‘dazzle’ being such a common term, we didn’t intend to infringe on your trademark. We believe our customers will not mistake this with your brand and product.

    We apologize for our mistake in that we were unaware of your trademark.
    I cannot stress enough to you how seriously I take intellectual property law. My own life depends upon respect for these laws.

    We will happily remove the term Dazzle from our listing. We promise it will never happen again.

    I am writing to respectfully request you to issue a retraction letter to Amazon. This will allow us to edit our listing.
